Welcome to YOEFI! These Terms of Service ("Terms") govern your access to and use of the YOEFI website ("Site") and its associated services. By using our Site, you agree to these Terms. If you don't agree with any part of these Terms, please don't use our Site.

1. Your Agreement with YOEFI

These Terms form the complete agreement between you and YOEFI regarding your use of our services, replacing any previous discussions or arrangements. They also incorporate important supporting documents:

  • Our Cookie Policy: This policy details how our Site uses cookies.

We'll only use your personal information as outlined in our Privacy Policy.

4. Permitted and Prohibited Conduct

4.1 Permitted Use

You may only use our Site for lawful purposes.

4.2 Prohibited Use

You must not use our Site in any way that:

  • Violates any applicable local, national, or international law or regulation.
  • Is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • Aims to harm or attempt to harm minors.
  • Attempts to bully, insult, intimidate, or humiliate anyone.
  • Transmits or sends any unsolicited or unauthorized advertising or promotional material (spam).
  • Knowingly transmits any data, or sends or uploads any material containing viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware, or any other harmful programs or computer code designed to negatively affect computer software or hardware.

You also agree not to:

  • Access without permission, interfere with, damage, or disrupt any part of our Site; any equipment or network where our Site is stored; any software used to provide our Site; or any equipment, network, or software owned or used by any third party.
  • Attack our Site using a denial-of-service attack or a distributed denial-of-service attack.
  • Place an unreasonable or disproportionately large load on the Site's infrastructure, systems, or networks.
  • Reverse look-up, trace, or attempt to trace any information about other users or visitors to the Site to its source, or exploit the Site or any service to reveal personal information (other than your own).
  • Attempt to gain unauthorized access to any part or feature of the Site, or any other connected systems or networks, or to any of our servers or services, by password mining, hacking, or other illegitimate means.
  • Use any automatic device, program, algorithm, or methodology, or any similar manual process to access, copy, acquire, or monitor any part of the Site, or to reproduce or bypass its navigation or presentation, to obtain materials, documents, or information not purposely made available through the Site.
  • Use any device, software, or routine to interfere or attempt to interfere with the proper working of the Site, any transaction on the Site, or any person’s use of the site.
  • Scan, probe, or test the vulnerability of the Site or any network connected to it, or breach the security or authentication measures on the Site or any connected network.

Violating these provisions is a criminal offense under the Computer Misuse Act 1990. We'll report any such breach to the relevant law enforcement authorities and will cooperate with those authorities by disclosing your identity to them. If such a breach occurs, your right to use our Site will immediately cease.

5. Your Account Security

  • You must keep your account details safe. Any user identification code, password, or other security information provided to you must be treated as confidential. Don't disclose it to any third party.
  • We can disable any user identification code or password, whether chosen by you or allocated by us, at any time, if we reasonably believe you've failed to comply with any of these Terms.
  • If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@yoefi.com.
  • You are also responsible for ensuring that anyone who accesses our Site through your internet connection is aware of and complies with these Terms and other applicable conditions.

6. Content Use and Service Access

  • You must not alter any paper or digital copies of materials you've printed or downloaded. Also, don't use illustrations, photographs, video or audio sequences, or graphics separately from their accompanying text.
  • Our status (and that of any identified contributors) as the authors of content on our Site must always be acknowledged.
  • You must not use any part of the content on our Site for commercial purposes without obtaining a license from us or our licensors.
  • If you print, copy, or download any part of our Site in violation of these Terms, your right to use our Site will end immediately. You must then, at our option, return or destroy any copies of the materials you've made.
  • If you subscribe to a service that allows you to upload data, information, and content, additional terms regarding the ownership and use of that data will be outlined in the relevant Terms and Conditions of Service.
  • If you fail to pay any fees required to access certain platforms, areas, or features on the Site, you won't be permitted to access or use them until payment is received.

7. YOEFI's Purpose

YOEFI is a self-service estate planning platform. It provides tools to help you organise your financial and legal affairs, including recording your assets and liabilities, managing your relationships and beneficiaries, tracking gifts, creating Lasting Powers of Attorney, and estimating your Inheritance Tax liability. YOEFI does not provide legal, financial, or tax advice.

By using YOEFI, you acknowledge and agree to the following:

7.1 Self-Service Tool

YOEFI is a self-service tool only. You make all decisions about the content and structure of any documents or information produced through the platform. YOEFI does not review, validate, or verify the accuracy, completeness, or legal sufficiency of any documents, calculations, or information generated through the Site. You are solely responsible for all decisions made and all content produced using the Site.

7.2 Your Estate Data

YOEFI provides self-service tools to help you record and organise information about your estate. This includes your assets (such as property, bank accounts, pensions, investments, vehicles, cryptocurrency, life insurance, business assets, agricultural property, and personal items), your liabilities (such as mortgages, loans, and credit cards), your relationships and beneficiaries, and any gifts you have made.

All information displayed through these tools — including asset valuations, ownership structures, beneficiary designations, and net worth calculations — is based entirely on data you input. YOEFI does not independently verify, value, or audit any of this information. You are solely responsible for ensuring that the data you enter is accurate, complete, and up to date.

Where YOEFI identifies potential tax reliefs, exemptions, or savings based on your data, these are indicative only and should not be treated as advice. You should always seek independent professional advice before relying on any such information.

7.3 Lasting Powers of Attorney

YOEFI provides tools to help you create Lasting Power of Attorney documents for submission to the Office of the Public Guardian (OPG). While YOEFI runs automated checks designed to catch common errors before submission, these checks do not constitute legal review and do not guarantee that your LPA will be accepted by the OPG or that it is legally valid.

You are solely responsible for:

  • The accuracy and completeness of all information you provide during the LPA creation process.
  • Ensuring that each person named in your LPA (attorneys, replacement attorneys, certificate providers, etc.) is eligible and willing to act in that role.
  • Reviewing any preferences, instructions, or decisions included in your LPA before finalising.
  • Printing, signing, and witnessing your LPA documents in accordance with the requirements set out by the OPG.
  • Submitting your signed forms to the OPG along with the applicable registration fee.
  • The legal validity of any LPA documents produced using this tool.

If you choose to use YOEFI's LPA tools, you agree that YOEFI will not be held responsible for any errors, omissions, or rejections arising from the documents produced. If you do not agree with these terms, please do not use the LPA tools.

We strongly recommend that you have any legal documents created through YOEFI reviewed by a qualified solicitor before signing and submitting them.

7.4 Inheritance Tax Calculator

YOEFI provides an Inheritance Tax (IHT) estimation tool that calculates an approximate tax liability based on the estate data you have entered into the platform. This calculator is for illustrative and informational purposes only. It does not constitute tax advice.

The calculator applies general UK IHT rules, allowances, and thresholds to the information you have provided. However:

  • Calculations are only as accurate as the data you enter.
  • The calculator may not account for every individual circumstance, exemption, or relief that could apply to your estate.
  • Tax rules and thresholds may change. YOEFI endeavours to keep the calculator current but does not guarantee that it reflects the latest legislation at all times.
  • The output should not be relied upon as a definitive statement of your tax liability.

You should consult a qualified tax adviser or accountant before making any financial decisions based on the calculator's output.

7.5 No Professional Advice

Nothing on the Site or produced by the Site's tools constitutes legal, financial, tax, or other professional advice. YOEFI is an information and document-preparation tool only. Always seek independent professional advice before acting on any information obtained through the Site.

7.6 Your Costs and Expenses

You are solely responsible for any and all costs and expenses you may incur while using the Site, including but not limited to: YOEFI service fees, OPG registration fees, professional review fees, and any costs arising from errors or omissions in documents or calculations you produce using the Site.

7.7 Limitation of Liability for Site Tools

To the fullest extent permitted by law, YOEFI accepts no liability for any loss, damage, cost, or expense (including but not limited to any direct, indirect, or consequential loss) arising from your use of, or reliance on, any document, calculation, information, or output generated through the Site. You use the platform entirely at your own risk.

8. YOEFI's AI Features

YOEFI integrates Large Language Models (LLMs) to provide certain functionalities, including AI-assisted drafting, validation, and guidance within the LPA creation process and estate planning tools. Please read the following important disclaimers:

  • AI Output Accuracy: While we strive for accuracy and utility, content generated by our LLMs may contain errors, inaccuracies, or 'hallucinations.' You should not rely on AI-generated content without independent verification, especially for critical decisions or information.
  • Not Professional Advice: Any information or content generated by YOEFI's AI features is for informational and assistive purposes only and should not be considered a substitute for professional advice (e.g., legal, financial, tax). Always consult with a qualified professional for advice tailored to your specific situation.
  • User Responsibility for Input and Output: You are solely responsible for all data, prompts, and information you input into YOEFI's AI features (your 'Input'). You are also solely responsible for reviewing, verifying, and assessing the suitability, accuracy, and legality of any content or information generated by YOEFI's AI features ('Output') before using or relying on it. You bear all risks associated with your use of the Output.
  • Data Usage with LLMs: You acknowledge that your Input may be processed by third-party LLM providers to generate Output. We strive to partner with LLM providers who commit not to use your Input data to train or improve their general models. However, you are responsible for understanding the data privacy policies of the underlying LLM providers as they may change. We recommend that you do not input any sensitive personal data, highly confidential information, or proprietary data into YOEFI's AI features unless explicitly required and you have confirmed the security and privacy implications.
  • Anonymised Data Processing: To protect your privacy, we abstract and anonymise all personal data before sending any requests to the Large Language Model (LLM). This process ensures that the LLM cannot associate the data used to produce documents with you.
  • No Warranty of Non-Infringement for AI Output: We do not warrant that AI-generated Output will not infringe on third-party intellectual property rights. You are responsible for ensuring that your use of AI-generated Output complies with all applicable intellectual property laws.
  • You are solely responsible for any and all costs and expenses you might incur in relation to your use of the Site, including any costs associated with verifying AI-generated content.

9. Limitation of Our Liability

The content on our Site is provided for general information only; it's not intended as advice you should rely on. You must seek professional or specialist advice before taking any action based on our Site's content.

While we make reasonable efforts to update the information on our Site, we make no representations, warranties, or guarantees, express or implied, that the content is accurate, complete, or up-to-date.

We don't guarantee that the Site will be free of defects or faults.

Links to other sites and resources provided by third parties on our Site are for your information only. Such links don't imply our approval of those linked websites or the information you may obtain from them. We have no control over their content.

We don't exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents, or subcontractors, and for fraud or fraudulent misrepresentation.

Please note that different limitations and exclusions of liability will apply to liability arising from the supply of any services to you, which will be detailed in our Terms and Conditions of Service.

This Site is for domestic and private use only. You agree not to use our site for any commercial or business purposes, and we'll have no liability to you for any loss, including loss of profit, loss of business, loss of data, business interruption, or loss of business opportunity.

While we'll use reasonable efforts to ensure the Site is secure and free of errors, viruses, and other malware, we offer no warranty in that regard. All users are responsible for their own security, including that of their personal details and computers. You are responsible for configuring your information technology, computer programs, and platform to access our Site. You should use your own virus protection software.

We accept no liability for any disruption or unavailability of the Site. We'll have no liability to you for any breach of these Terms caused by any event or circumstance beyond our reasonable control, including, but not limited to, strikes, lock-outs, or other industrial disputes, breakdown of systems or network access; or fire, flood, explosion, or accident.

10. Breach of Terms and Consequences

If we determine that a breach of these Terms has occurred, we may take appropriate action. This may include:

  • Immediate, temporary, or permanent withdrawal of your right to use our Site and/or any service provided through our Site.
  • Immediate, temporary, or permanent removal of any content you've uploaded to our site.
  • Issuing a warning to you.
  • Initiating legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Taking further legal action against you.
  • Disclosing such information to law enforcement authorities as we reasonably deem necessary or as required by law.

Non-compliance with these Terms may also result in the termination of your account and any existing subscriptions and services.

11. Intellectual Property Rights

Unless uploaded by a User, all content on the Site is the property of YOEFI Limited, our affiliates, or other relevant third parties. In these Terms, "Content" refers to any text, graphics, images, audio, video, software, data, compilations, page layout, underlying code and software, and any other form of information that can be stored in a computer and appears on or forms part of the Site, including any content uploaded by Users. By continuing to use the Site, you acknowledge that such Content is protected by copyright, trademarks, database rights, and other intellectual property rights.

YOEFI, our logos, and our other registered and unregistered trademarks are trademarks of YOEFI Limited. We don't grant permission for the use of these trademarks, and such use may infringe on our rights. Nothing on this Site should be interpreted as granting any license or right to use any trademark, logo, or service mark displayed on the site without prior written permission from YOEFI Limited.

12. Resolving Disputes and Contacting Us

13. Governing Law and Jurisdiction

These Terms, their subject matter, and their formation are governed by English or Welsh law. Both you and we agree that the courts of England or Wales will have exclusive jurisdiction.

If you access this Site from outside the UK, you're responsible for complying with local laws where they apply.
